1. Acceptance of These Terms

These Terms of Service (“Terms”) govern your access to and use of the Montreuil Guitar Studio website (the “Site”) and any related communications or booking requests submitted through it. By accessing the Site or submitting a request form, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference.

If you do not agree to these Terms, you must not use the Site. If you use the Site on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

Minimum age: the Site is intended for individuals who are at least 16 years old. If you are under 18, you should use the Site with parental or guardian supervision and only provide personal data with appropriate permission.

2. Educational and Professional Disclaimers

Montreuil Guitar Studio provides guitar instruction and related educational guidance. The Site content and any lesson information shared through the Site are provided for educational purposes and general information about our studio services in Paris, France. Nothing on the Site should be interpreted as a guarantee of results, a promise of performance outcomes, or an assurance of a particular level of progress.

Outcomes vary depending on factors such as starting level, practice consistency, practice duration, physical comfort, equipment, and scheduling. Any examples or typical scenarios referenced on the Site are illustrative and are not a promise of identical results.

If you experience pain, discomfort, or a medical condition related to playing an instrument, you should seek appropriate medical advice from a qualified professional. Montreuil Guitar Studio does not provide medical diagnosis or treatment.

3. Description of Services

Montreuil Guitar Studio offers guitar lessons and learning pathways that may include 1:1 sessions, structured practice plans, technique coaching, repertoire development, timing and rhythm work, and general guidance about tone and setup as it relates to playability. Services are delivered primarily in our Paris studio located at 18 Rue de Montreuil, 75011 Paris, France, unless otherwise agreed.

The Site allows you to request availability, share your learning goals, and contact us. Submitting a booking request does not automatically create a binding service contract or reserve a specific date/time until it is confirmed by Montreuil Guitar Studio through a direct response.

We may update, improve, suspend, or discontinue any part of the Site at any time. We may also adjust lesson formats, scheduling policies, or communications workflows as operational needs change, while aiming to keep the experience consistent and clear.

4. Booking Requests and Communications

When you submit a form on the Site, you agree to provide accurate and current information and to avoid submitting content that is unlawful, threatening, misleading, or inappropriate. You also agree not to impersonate another person or misrepresent your affiliation.

We typically reply to booking requests within 1 business day on weekdays; response times can vary based on holidays, high demand, or operational constraints. You acknowledge that email delivery is not always instantaneous and can be affected by spam filters, network delays, or incorrect addresses.

5. Acceptable Use

You agree to use the Site lawfully and in a way that does not harm the Site, our business operations, or other users. In particular, you agree not to:

  • Attempt to gain unauthorized access to any part of the Site, its servers, or connected systems.
  • Interfere with or disrupt the Site, including by introducing malware, bots, or abusive traffic.
  • Scrape, crawl, or harvest content or data from the Site using automated means without our prior written permission.
  • Submit false or misleading information through forms, or use forms for spam or unsolicited promotions.
  • Bypass security or consent mechanisms, including cookie preference controls.
  • Use the Site in a way that violates applicable laws or regulations in France or your place of residence.

We may suspend or block access to the Site if we believe, in good faith, that you have violated these Terms or that your use poses a security risk.

6. Intellectual Property

The Site and all content on it, including text, design elements, lesson descriptions, logos, and any downloadable materials provided directly by Montreuil Guitar Studio, are owned by or licensed to MK HOLDING SAS and are protected by applicable intellectual property laws.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for your personal, non-commercial purposes. You may not copy, reproduce, republish, distribute, modify, create derivative works from, or commercially exploit the Site content without our prior written consent.

7. Third-Party Services and Links

The Site may reference third-party services that are used to deliver standard website functionality (for example, internet infrastructure providers) or may link to third-party resources as part of service operations. When you leave our Site, third-party terms and policies apply. We do not control third-party content and are not responsible for it.

The presence of a third-party name does not imply endorsement unless we explicitly state otherwise.

8. Disclaimer of Warranties

The Site and its content are provided on an “as is” and “as available” basis. To the maximum extent permitted by applicable law, MK HOLDING SAS disclaims all warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Site will be uninterrupted, error-free, secure, or free of harmful components, or that any defects will be corrected. We also do not warrant the accuracy, completeness, or reliability of any content on the Site.

9. Limitation of Liability

To the maximum extent permitted by law, MK HOLDING SAS and its officers, employees, contractors, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of data, or business interruption, arising out of or related to your use of (or inability to use) the Site.

To the extent that liability cannot be excluded, our total liability for all claims related to the Site will be limited to the greater of (a) the amounts paid by you to MK HOLDING SAS in the 12 months immediately preceding the event giving rise to the claim, or (b) €100.

Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for willful misconduct, fraud, or other non-excludable statutory protections.

10. Indemnification

You agree to indemnify and hold harmless MK HOLDING SAS from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from or relating to: (a) your use of the Site; (b) your violation of these Terms; (c) your submission of unlawful or infringing content; or (d) your violation of any law or the rights of a third party.

11. Force Majeure

MK HOLDING SAS will not be liable for any failure or delay in performance caused by events beyond our reasonable control, including acts of God, natural disasters, war, terrorism, labor disputes, pandemics, power outages, internet or telecommunications failures, cyberattacks, and failures of hosting or cloud infrastructure providers.

12. International Use

The Site is operated from France. We make no representation that the Site is appropriate or available for use in every jurisdiction. If you access the Site from outside France, you are responsible for compliance with local laws to the extent they apply.

13. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of France, without regard to conflict of law rules. Subject to any mandatory consumer protection rules that may apply, the courts of Paris, France will have jurisdiction over disputes arising out of or relating to these Terms or the Site.

If you are a consumer residing in the European Union, you may also benefit from mandatory protections under the consumer laws of your country of residence, and you may have the right to bring a claim in the courts of your home country where applicable.

14. Dispute Resolution

Before filing a formal claim, you agree to contact us and provide a brief written description of the issue so we can attempt to resolve it informally. Unless prohibited by law, you agree to allow at least 30 days for informal resolution after contacting us.

15. Termination

We may suspend or terminate your access to the Site at any time if we believe you have violated these Terms or if your use presents a security, legal, or operational risk. You may stop using the Site at any time.

Sections relating to intellectual property, disclaimers, limitation of liability, indemnification, governing law, and other provisions that by their nature should survive will survive termination.

16. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be deemed severable and will not affect the validity and enforceability of the remaining provisions.

17. Entire Agreement

These Terms, together with the Privacy Policy and Cookie Policy, constitute the entire agreement between you and MK HOLDING SAS regarding your use of the Site and supersede any prior or contemporaneous understandings on the same subject.

18. Assignment

MK HOLDING SAS may assign these Terms, in whole or in part, to an affiliate or successor entity in connection with a merger, acquisition, restructuring, or sale of assets. You may not assign or transfer these Terms without our prior written consent.

19. No Waiver

Our failure to enforce any provision of these Terms will not be considered a waiver of our right to enforce that provision later. Any waiver must be in writing and signed by an authorized representative of MK HOLDING SAS.

20. Modifications to These Terms

We may update these Terms from time to time to reflect changes in operations, legal requirements, or Site functionality. Changes will be effective 14 days after posting the updated Terms on this page, unless a change is required by law to take effect sooner.

Your continued use of the Site after the effective date of updated Terms constitutes acceptance of the updated Terms.

21. Electronic Communications

You consent to receiving communications from us electronically (for example, by email) regarding booking requests or Site-related notices. You agree that electronic communications satisfy legal requirements for communications to be in writing, where applicable, consistent with eIDAS in the European Union.
